Terms & Conditions HD Premier Lawns

Please read these terms and conditions carefully before using our services.

1. Agreement to Terms

By engaging HD Premier Lawns for lawn care and landscaping services, you agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you ("Customer" or "You") and HD Premier Lawns ("Company," "We," or "Us").

If you do not agree to these terms, please do not use our services. We reserve the right to modify these terms at any time, and such modifications will be effective immediately upon posting.

2. Services Provided

HD Premier Lawns provides professional lawn care and landscaping services including but not limited to:

  • Lawn mowing and grass cutting
  • Edging and trimming
  • Fertilization and weed control
  • Landscaping design and installation
  • Leaf and debris cleanup
  • Seasonal lawn maintenance

All services are subject to weather conditions, property accessibility, and seasonal availability. We reserve the right to modify or discontinue services with reasonable notice.

3. Scheduling and Property Access

Scheduling: Services are scheduled based on availability and weather conditions. We will make reasonable efforts to maintain regular service schedules but cannot guarantee specific dates or times due to weather dependencies.

Property Access: Customer must provide safe and reasonable access to all areas requiring service. This includes:

  • Unlocked gates or access codes
  • Clear pathways free from obstacles
  • Secure pets during service visits
  • Notification of any hazards or special conditions

If access is not available on the scheduled service day, a service fee may apply for return visits.

4. Pricing and Payment Terms

Pricing: All service prices are provided as estimates and may be adjusted based on actual property conditions, scope of work, and any additional services requested.

Payment Terms:

  • Payment is due upon completion of services unless other arrangements are made
  • We accept cash, check, and major credit cards
  • Late payments may incur a 1.5% monthly service charge
  • Returned checks will incur a $35 fee

Service Interruption: Services may be suspended for accounts with outstanding balances over 30 days past due.

5. Cancellation and Refund Policy

Service Cancellation: Either party may cancel services with 48 hours advance notice. Emergency weather-related cancellations by the Company will not incur charges.

Contract Termination: Recurring service contracts may be terminated by either party with 30 days written notice. Customer is responsible for payment of all services rendered prior to termination.

Refunds: Refunds for services are evaluated on a case-by-case basis and are at the discretion of HD Premier Lawns management.

6. Liability and Insurance

Insurance Coverage: HD Premier Lawns maintains general liability insurance and workers' compensation coverage as required by law.

Property Damage: We will take reasonable care to protect your property during service. In the event of damage caused by our negligence, we will repair or replace damaged items at our discretion.

Limitation of Liability: Our liability is limited to the cost of the specific service that caused the damage. We are not responsible for:

  • Pre-existing conditions or damage
  • Damage caused by weather, pests, or disease
  • Underground utilities not properly marked
  • Items left on the property that obstruct service

7. Customer Responsibilities

Customer agrees to:

  • Provide accurate contact information and property details
  • Ensure safe working conditions and property access
  • Remove or secure personal items that may interfere with service
  • Notify us of any changes to property conditions or access requirements
  • Maintain communication regarding scheduling and service needs
  • Comply with HOA or local ordinances regarding lawn maintenance

8. Weather and Force Majeure

HD Premier Lawns shall not be liable for delays or inability to perform services due to weather conditions, natural disasters, government regulations, labor disputes, or other circumstances beyond our reasonable control.

Services postponed due to weather will be rescheduled as soon as conditions permit. No charges will apply for weather-related service delays or cancellations.

9. Privacy and Communication

We respect your privacy and will not share your personal information with third parties except as necessary to provide services or as required by law.

By providing your contact information, you consent to receive communications from HD Premier Lawns regarding scheduling, services, and account matters via phone, text, or email.

10. Governing Law and Disputes

These terms are governed by the laws of the State of Florida. Any disputes arising from these terms or our services will be resolved through binding arbitration in Orange County, Florida.

Both parties agree to attempt resolution through good faith negotiation before pursuing formal dispute resolution procedures.
